What is the difference?

if an uninsured motorist crushes and damages my arm in a car accident with100 perdent liabiltyand pleads guilty, from a person clubbing my arm and injuring it meliciously.both are criminal acts so shouldnt both criminals be libel to pay restitution to the victim.some say not the uninsured driver,who in my view acted more criminally then the clubber.cant accept the answers im getting,still cant beleive tha mugger pays and the uninsured worse criminal walks.need to know why one crime warrents punitive damages from the individual and one dont.how do you ault someone,weather it be with a club or car and not get court ordered restitution for your injury.she can pay
